Earlier prayer for bail of the petitioner was rejected by this court giving liberty to him to renew his prayer for bail after recording the deposition of the victim in course of trial. Now, the victim has already been examined before the trial court as prosecution witness no.2 but she has not supported the story of kidnapping and rape.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge I, Nawada-cum- Special Judge, POCSO Act in POCSO trial no. 09/2015 arising out of Nardiganj P.S. Case no. 112/2013. shahid (Hemant Kumar Srivastava,J) U T
