The petitioner seeks bail in a case registered for the offence under Sections 302/34 of the Indian Penal Code. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has not committed any offence. In fact, the husband of the informant fell down from the tempo while he was returning from birthday party. The petitioner is rotting in judicial custody since 31.03.2019.

Learned A.P.P. for the State opposed the prayer for bail of the petitioner and submitted that in course of investigation the case was found true against the petitioner and police has accordingly submitted the charge sheet.

Patna High Court CR. MISC. No.64389 of 2019(3) dt.18-12-2019 2/2 Considering the facts and circumstances of the case, this Court is not inclined to enlarge the petitioner on bail. Accordingly, the prayer for bail of this petitioner is rejected.
