The petitioner seeks regular bail in Mithanpura P.S. Case No.123 of 2017 registered for the offence under Section 290/34 of the I.P.C. and 30 (a) of the Bihar Prohibition and Excise Act.

Allegation against the petitioner is of recovery of 107.28 liters liquor from the car from which the persons including the petitioner were seen fleeing away. It is further alleged that he is accused in one more case.

No.42064 of 2017 (2) dt.11-09-2017 petitioner is that he has been falsely implicated in this case at the instance of his cousin brother and he is in custody for three months, Heard learned A.P.P. also who opposed the prayer for bail on the ground of recovery as well as he has criminal antecedent.

Having heard both sides and in view of the facts and circumstances, as stated above, at this stage I am not inclined to grant bail to the petitioner. However, learned trial court is directed to expedite the trial and conclude within a period of four months, if not concluded, the petitioner will be released on bail to the satisfaction of the trial court..

With the aforesaid observation this application is disposed of.
