The petitioners seek bail in a case registered under Sections 341,323, 379, 354(B), 307, 324, 504, 506/34 of the Indian Penal Code.

The prosecution case in short is that in course of drinking water on Chapakal, the accused persons assaulted the informant and while informant's family members came to rescue him, they were also assaulted with Lathi and iron rod.

It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no

Patna High Court CR. MISC. No.60097 of 2019(2) dt.24-09-2019 2/2 allegation of tampering of witnesses alleged against the petitioners. The petitioners are in custody since 06-07-2019 Charge sheet has already been submitted. There is case and counter case between the parties. Free fight is alleged to have taken place between the parties. The injury on the side of the accused has not been explained by the prosecution. The prosecution has not come with clean hands.

On behalf of the State, it is submitted that the petitioners are named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Sri A.S. Prasad, learned Judicial Magistrate-Ist Class, Jhanjharpur, Madhubani in connection with Madhepur P.S. Case No. 101 of 2019. (Sudhir Singh, J) A.K.V.//- U T
