This is an application for bail in connection with Dhibra P.S. Case No. 1 of 2016 registered for the offences punishable under Sections 147, 148, 149, 326, 353, 307, 414, 386, 121, 121A of the Indian Penal Code and 25(1-B)(a), 26, 27 of the Arms Act, including 17 CLA Act.

Allegation against the accused persons, including the petitioner is of firing on police party when the police raided the place and petitioner is named in the FIR along with 22 other persons.

Submission of learned counsel for the petitioner is that except he is named there is nothing against the petitioner and other co-accused, who is also named in FIR, has been granted bail in Cr.Misc.No.33790 of 2016, vide order dated 10.11.2016, by a coordinate Bench of this Court and petitioner is in custody since 21.1.2017.

Patna High Court Cr.Misc. No.41277 of 2017 (2) dt.07-09-2017 2/2 Heard learned APP also, who has opposed the prayer for bail stating that he is accused in five other cases also. Having heard both sides and in view of fact that other similarly situated co-accused has been granted bail, let petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad, in connection with Dhibra P.S. Case No. 1 of 2016, subject to the following conditions :- (1) One of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned, (2) Petitioner will mark his attendance in local police station in first week of every month till conclusion of trial, failing which his bail bond shall be cancelled.
