The petitioner seeks bail in connection with Civil Lines P.S. Case No. 382 of 2018, registered under Section 379 of Indian Penal Code, pending in the Court of learned Chief Judicial Magistrate, Gaya.

Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R that regarding the theft of the motorcycle of the informant Siyaram Prasad, Civil Lines P.S. Case No. 382 of 2018 was registered under Section 379 of Indian Penal Code against unknown on 23.09.2018, later on, Police reached in the orchard from where the petitioner along with Prem Chand Kumar apprehended with the stolen motorcycle. Further submission is that petitioner is

Patna High Court CR. MISC. No.57039 of 2019(3) dt.04-12-2019 2/2 accused in similar nature of case, due to that reasons, the Police got implicated the petitioner in the present case. Having considered the facts and circumstances of the case and nature of allegation, I am not inclined to enlarge the petitioner on bail. Accordingly, the prayer of the petitioner, above named, is rejected. However, petitioner would be at liberty to renew his prayer for bail after six months. (Rajendra Kumar Mishra, J) manish/- U T
