The petitioner seeks bail in connection with Bidupur P.S. Case No.187 of 2014 registered under sections 406, 409, 419 and 420 read with 34 of the Indian Penal Code (for short "the Code") It is contended by the learned counsel for the petitioner that initially a complaint case was filed in the court of Chief Judicial Magistrate, Vaishali at Hajipur which was referred to the police under Section 156(3) of the Code of Criminal Procedure for investigation pursuant to which the FIR has been instituted. It has been further contended that the present case is nothing but a counter blast of Shahupur P.S. Case No.8 of 2014 dated 9.1.2014 registered under Sections 420 and 406 of the Code in the district of Kolhapur, Maharashtra. The said case was registered at the

Patna High Court Cr.Misc. No.56119 of 2015 (2) dt.16-12-2015 2/2 instance of father of the petitioner against one Bipin Kumar. As a matter of fact, the informant Chandan Kumar is cousin of the said Bipin Kumar who cheated him of Rs.2,50,000/- on giving assurance for providing job to his son.

Learned counsel for the informant has vehemently opposed the prayer made on behalf of the petitioner. He has contended that the informant of the case is not related in any manner to Bipin Kumar. He has further contended that there is ample evidence to show that the petitioner and his father have cheated the informant of the present case.

Be that as it may, regard being had to the nature of dispute, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.25,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Bidupur P.S. Case No.187 of 2014.
