The petitioner seeks bail in a case registered for offences under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.
It is contended that as per allegation, 44.80 litres of country-made liquor and 8.64 of foreign liquor, i.e., total 53.44 litres were allegedly recovered from the joint possession of the petitioner and three co-accused persons. Petitioner claims that he is having clean antecedent and is in custody since 14.06.2017.
Patna High Court Cr.Misc. No.39284 of 2017(2) dt.19-08-2017 2/2 Considering the facts and the circumstances of the case, the petitioner, above named is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II, Gopalganj in connection with Excise Case No. 346 of 2017 with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
