2. The petitioner has prayed for regular bail in a case instituted for the offence under Section 30(a) of the Bihar Prohibition and Excise Act.
3 As per FIR, it is a case of recovery of wine.
4. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. It is further submitted that the name of the petitioner came on the basis of confessional statement of apprehended accused who driving the vehicle in question. The petitioner was not apprehended on the spot. The petitioner is in custody since 03.06.2023.
5. The application for bail is opposed by learned APP
Patna High Court CR. MISC. No.65549 of 2023(2) dt.13-10-2023 2/2 for the State.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Judge, Excise Court No.1, Rohtas at Sasaram, in connection with Dawath P.S.
