JUSTICE VINOD KUMAR SINHA ORAL ORDER 30-09-2019 This application, for grant of anticipatory bail, arises out of Kotwali P.S. Case No. 231 of 2019, disclosing offences under Sections 419, 420, 465, 471, 139 and 120-B of the Indian Penal Code.

Petitioner happens to be Police Inspector and I.O. of Buddhar Colony P.S. Case No. 383/17 and he has submitted the charge-sheet against the accused persons of that case. Present case has been filed at the instance of the Director General of Police, Patna with allegation that petitioner and other Investigating Officers of Kotwali P.S. Case No. 571/17 and Kotwali P.S. Case No. 664/2017 cooperated the informant of all the above three cases to recover money based on false evidence by hatching a conspiracy. Submission of learned counsel for the petitioner is that petitioner has submitted the charge-sheet against the accused of

Patna High Court CR. MISC. No.61996 of 2019(2) dt.30-09-2019 2/2 Buddha Colony P.S. Case No. 383/17 after supervision note of Deputy Superintendent of Police, Patna and he has falsely been implicated in this case. He is a Government servant and there is no chance of his absconding and he is ready to abide by any condition imposed on him.

Having heard both sides, considering the facts and circumstances, let petitioner surrender in the court below within three weeks from the date of receipt of a copy of this order in the court below, on which, he will be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Patna, in connection with Kotwali P.S. Case No. 231 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.

It is further subject to the condition that petitioner shall cooperate in the investigation and appear before the Investigating Officer / authorities concerned, as and when required and will also cooperate in departmental proceeding, if any, initiated against him.
