JUSTICE DINESH KUMAR SINGH ORAL ORDER 06-01-2016 Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 307, 354, 379, 504 of the Indian Penal Code.

It is alleged that nine accused persons named in the F.I.R including the petitioners came variously armed and assaulted the informant, informant's son, sister, nephew and mother.

It is submitted by learned counsel for the petitioners that injuries have been found to be simple in nature. There is counter version of the occurrence and

Patna High Court Cr.Misc. No.267 of 2016 (2) dt.06-01-2016 2/2 petitioners' side also received injuries. Moreover the informant has retracted from the initial version and has filed a petition to that effect before learned Court below.

A statement has been made in para 3 of the petition that petitioners have no criminal antecedent. Considering the aforesaid facts, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Benipatti, Madhubani in connection with Bisfi P.S. Case No. 169 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) Shageer/- U T
