2. The petitioner seeks regular bail in connection with Mirganj P.S. Case No. 334 of 2025 for the offence registered under Section 317(5) of the IPC and Section 30 (a) of the Bihar Prohibition & Excise Act.

3. As per the prosecution case, during patrolling duty, police apprehended the petitioner and one motorcycle without number plate, on search total 78.800 litres of country made liquor was recovered. On seeing the police, the co-accused Alok @ Mukesh Yadav who was driving the motorcycle fled away from the spot.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. Petitioner has no concern with the seized liquor or

He further submits that the petitioner in good faith taken lift from co-accused Alok @ Mukesh Yadav on the vehicle. Petitioner is in jail custody since 25.06.2025, having no criminal antecedent. Petitioner undertakes to cooperate in the trial of the case.

5. Learned APP for the State has opposed the prayer for regular bail of the petitioner.

Considering the facts and circumstances of the case and the submissions of learned counsel for the parties and period of custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-IV-cum-Exclusive Special Excise Court -II, Gopalganj, in connection with Mirganj P.S. Case No. 334 of 2025.
