JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-12-2015 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307, 34 of the Indian Penal Code and Section 3(1)(x) of the SC & ST (Prevention of Atrocities) Act.

The prosecution case is that husband of the informant inadvertently broke the flower plant, as a result accused persons caught her husband when this petitioner assaulted with farsa on the head of the husband of the informant.

It is submitted by learned counsel for the petitioner that injury has been found to be simple and for the occurrence of 31.08.2015 the First Information Report was registered on 04.09.2015 which reached to the Court of learned C.J.M on 07.09.2015.

The delayed lodging of the case and the nature

Patna High Court Cr.Misc. No.57247 of 2015 (2) dt.18-12-2015 2/2 of injury caused constitute ground for consideration of prayer for regular bail, if the petitioner surrenders within a period of six weeks in connection with Hulasganj P.S. Case No. 73 of 2015, pending in the Court of learned Chief Judicial Magistrate, Jehanabad.

With the observations above, the application stands disposed off.
