JUSTICE SANJAY PRIYA ORAL ORDER 09-08-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Siwan Rail P.S. Case No. 20 of 2017 instituted for the offence under Sections-379,411/34 of the Indian Penal Code.

It is alleged that while the informant was coming from Siwan by passenger train, one boy snatched his mobile and started running away along with three other friends. It is alleged that the informant chased them and in the meantime, one of the boy gave the mobile to this petitioner who also started running away but in the meantime, the police arrived and he was apprehended by the police. As such, from the written report itself, it appears that there is no specific allegation against this petitioner of snatching the mobile of the informant. In paragraph-3 of the petition, it has been mentioned that the petitioner has no criminal antecedent.

In such circumstances, prayer for bail is allowed. The petitioner named above is directed to be released on bail on furnishing

Patna High Court Cr.Misc. No.37890 of 2017 (2) dt.09-08-2017 bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Siwan Rail P.S. Case No. 20 of 2017 to the satisfaction of learned Additional Chief Judicial Magistrate, Railway, Sonepur, Saran subject to condition that both the bailors should be close relative of the petitioner.
