The petitioner seeks bail in connection with Rajiv Nagar P.S. Case No.49 of 2017 registered under Sections 363 and 365 of I.P.C.

Allegation of the informant, Deo Janam Rajak, is that his son Deepak Kumar is missing since 24.02.2017 who used to work of carpenter with Mantu Barhai. In course of work his son Deepak Kumar used to talk with Indu Devi who happens to be the sisterin-law of the wife of the petitioner. Despite search by the informant, his son has not been traced out. Patna High Court Cr.Misc. No.38120 of 2017 (5) dt.14-12-2017 2/2 suspicion that the petitioner has managed to conceal his son, Deepak Kumar.

Learned counsel for the petitioner submits that it would appear from the F.I.R. that the son of the informant was missing on 24.02.2017 but the F.I.R. was lodged on 06.03.2017 on mere suspicion only on the ground that his son used to work with the petitioner in course of which he used to talk with the sister of the wife of the petitioner. The statement of Indu Devi is detailed in para 17 of the case diary wherein she has admitted about the talk on mobile with the son of the informant and she also admitted that her relation with his son was of brother and sister. Petitioner has no criminal antecedent and he is in custody since 09.03.2017. Having considered the facts and the circumstances of the case, let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-CUM-Sub Judge-III, Patna, in connection with Rajiv Nagar P.S. Case No.49 of 2017.
