This is an application for bail in connection with Sessions Trial No. 71 of 2017, arising out of Chandramandih P.S.Case No. 76 of 2016 registered for the offences punishable under Sections 302/34 and 120B of the Indian Penal Code.

Petitioner is not named in the FIR and his name transpires in the self confession of the petitioner. Submission of learned counsel for the petitioner is that except his self confession before police there is nothing against him and he is in custody since 29.9.2016. Further submission is that in this case charge has been framed.

Heard learned APP also, who could not controvert the above submission.

No.39337 of 2017 (3) dt.09-10-2017 2/2 Having heard both sides and in the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Additional District Judge-I, Jamui, in connection with Sessions Trial No. 71 of 2017, arising out of Chandramandih P.S.Case No. 76 of 2016, subject to the following conditions :- (1) One of the bailors shall be a local person having sufficient immoveable properties in the jurisdiction of court concerned, (2) Petitioner shall co-operate in trial and appear on each and every date fixed in court and failure to appear on two consecutive dates without any genuine reason or without permission of court, his bail bond shall be liable to be cancelled.
