2. The petitioner has preferred this application for grant of regular bail in connection with Sadar Hajipur P.S. Case No. 469 of 2025, dated 13.06.2025 registered for the offences punishable under Sections 109(1) and 132 read with Section 3(5) of the BNS and under Sections 25(1-B)(a), 26, 27 and 35 of the Arms Act.

3. As per the prosecution case, on 13.06.2025 at about 12:35 AM, the informant received information that coaccused Rajiv Mali was seen at Malmalla Chowr and when the informant along with the Police personnel reached the alleged place, the co-accused persons along with the petitioner started

Patna High Court CR. MISC. No.59734 of 2025(2) dt.01-09-2025 2/3 firing on the Police party and in this firing, the co-accused Rajiv Mali was shot on his leg. Thereafter, Police apprehended Rajiv Mali and the petitioner while two persons managed to flee. From the possession of petitioner, a country-made pistol and a live cartridge were recovered.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner and petitioner has no concern with the alleged recovery. The petitioner has two criminal antecedents as stated in paragraph no. 3 of the bail petition. The petitioner is in custody since 14.06.2025.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as petitioner's period of custody, the petitioner, above-named, is directed to be enlarged on bail on furnishing bail-bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Sadar Hajipur P.S. Case No. 469 of 2025, on further condition:

No.59734 of 2025(2) dt.01-09-2025 3/3 (i) The petitioner is directed to remain physically present before the learned trial Court on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.
