KUMAR ORAL ORDER 10-08-2017 Heard learned counsels appearing on behalf of the petitioner and the State.

The petitioner seeks regular bail in a case instituted for the offence punishable under Section 414 of the Indian Penal Code. The prosecution case as lodged on the basis of written report of S.H.O., Ara Railway Police Station is that at the time of patrolling duty, the petitioner along with other co-accused were apprehended and on search, one wrist watch of Tata sonata company, Rs. 2610/- cash and two mobiles were recovered from the conscious possession of the petitioner.

Learned counsel for the petitioner has submitted that he has no criminal antecedent but by mistake from para-25 of the case diary it appears that the petitioner is a charge sheeted accused in

Patna High Court Cr.Misc. No.36683 of 2017 (2) dt.10-08-2017 2/2 Ara Rail P. S. Case No. 36 of 1999 and he is in custody since 01.05.2017.

Considering the above facts and circumstances of the case, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- ( Ten thousand) with two sureties of the like amount each in connection with Ara Rail P.S.Case No. 27 of 2017 to the satisfaction of learned Additional Chief Judicial Magistrate, Rail, Ara.
