The petitioner seeks pre-arrest bail in connection with Pandaul P.S. Case No. 223 of 2018, registered under Section 304B/34 of the Indian Penal Code, pending in the Court of Sessions Judge, Madhubani.

The accusation is of killing of the daughter of the informant due to non-fulfillment of demand of dowry within two years of marriage while she had one male child. Submission is that the petitioner is husband of the deceased. In fact, she had gone to attend the call of nature towards railway track and on seeing the train on railway track, she tried to cross the track, but, due to pressure of the air of the passing of the train, she fell down near the track and sustained injury. Further, submission is that the petitioner is in custody

Having regard to the facts and circumstances of the case, I am inclined to grant bail to the petitioner. The prayer for bail is rejected.
