19-09-2017 Heard Sri Pranay Shankar Sinha, learned counsel assisted by Sri Rajesh Shankar Sinha, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody in Gopalpur P.S. Case No. 87 of 2017, Special Case No. 2575 of 2017 registered for offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016 since 09-06-2017, has prayed for grant of bail. Learned counsel for the petitioner submits that nothing was recovered from the conscious possession of the petitioner, however; it was shown recovery of about 73 liters of Indian make foreign liquor. Learned counsel for the petitioner has drawn my attention to the statement made in paragraph - 3 of the petition to show that petitioner is having clean antecedent.

No.37932 of 2017(5) dt.19-09-2017 2/2 Considering the nature of accusation, clean antecedent as well as period of custody, let the petitioner namely Pinku Kumar @ Billa be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge Excise, Patna in connection with Gopalpur P.S. Case No. 87 of 2017, Special Case No. 2575 of 2017.
