21-01-2016 Heard Sri Arvind Kumar Singh, learned counsel for the petitioner and Sri Gauri Shankar Gupta, learned Addl. Public Prosecutor.

The petitioner, who is in custody in Sahail P.S. Case no. 11 of 2015 registered for the offence under Sections 392 & 411 of the Indian Penal Code, sections 25(1-b)A, 26 & 35 of the Arms Act, 1959 and section 17 of the C.L.A. Act, has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that F.I.R. was lodged against four accused persons, including the petitioner, whereas other two accused persons namely Lokesh Kumar Yadav and Janki Yadav have been granted bail by learned Sessions Judge, Gaya, vide B.P. No. 2751 of 2015. It was further

Patna High Court Cr.Misc. No.57687 of 2015 (2) dt.21-01-2016 2/2 submitted by learned counsel for the petitioner that the petitioner is having clean antecedent, which fact has been incorporated in paragraph - 3 of the petition.

In view of submission made by learned counsel for the petitioner that other two accused persons, almost in identical situation, have been granted bail, there is no reason to deny the prayer for bail of the petitioner.

Let the petitioner namely Pachu Yadav be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri G.N. Dubey, learned J.M. Ist Class, Sherghati, Gaya in connection with Sahail P.S. Case No. 11 of 2015.
