The petitioners have filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 504, 506 of the Indian Penal Code.

The allegation against the accused persons including the petitioners is of abusing and assaulting the informant and his family members by means of lathi, danda, iron rod etc. as a result of which they sustained injury.

It is submitted by learned counsel for the petitioners that the petitioners are innocent and have committed no offence. They

No specific allegation against the petitioners. All the allegations levelled against them are general and omnibus. There is nothing on record to show that any one has received grievous injury. A statement has been made in para 3 of the petition that petitioners have no criminal antecedent. It is also submitted that petitioners are languishing in judicial custody since19.06.2023.

Learned APP appearing for the State has vehemently opposed the prayer for Bail.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case as well as period of custody, this Court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be enlarged on bail in connection with Muffasil P.S. Case No. 672 of 2023 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya.
