19-09-2017 Heard Sri Patanjali Rishi, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody in Kalyanpur P.S. Case No. 31 of 2017 registered for offence under Sections 272, 273 & 34 of the Indian Penal Code and Sections 30 & 38 of the Bihar Prohibition and Excise Act, 2016 since 14-06-2017, has prayed for grant of bail.

Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case on an allegation that petitioner was dealing with the sale of Indian make foreign liquor. He further submits that other two accused persons, who were apprehended at the place of occurrence, have already been granted bail.

Considering the nature of accusation, period of custody

Patna High Court Cr.Misc. No.39583 of 2017(3) dt.19-09-2017 2/2 as well as the fact that other two accused have already been granted bail, there is no reason to further detain the petitioner. Let the petitioner namely Munna Rai be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge VI, Samastipur in connection with Kalyanpur P.S.
