The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 324, 506 and 308/34 of the Indian Penal Code. The prosecution case is that the petitioner made an attempt to assault the informant by knife when the informant received injury on his hand. The accused persons also assaulted the son of the informant.
It is submitted by learned counsel for the petitioner that injury has been found to be simple in nature and from the accusation itself it appears that the petitioner had no intention to kill the informant. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
Patna High Court Cr.Misc. No.56830 of 2015 (2) dt.16-12-2015 2/2 The aforesaid facts constitute ground for consideration of prayer for regular bail. Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Siwan Town P.S. Case No.63/2015, pending before the learned CJM, Siwan.
With the above observation, this application is, accordingly, disposed off.
