JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-01-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner along with two others is named in the first information report with accusation that he and other two accused assaulted the deceased with bricks, stone and iron-rod as a result of which deceased died then and there.
Two F.I.R. named accused namely Puja Devi @ Smt. Puja Devi as well as Umesh Singh having similar allegation have already been granted privilege of bail by Co-ordinate Benches of this Court. Furthermore, it would appear that while granting privilege of bail to one co-accused namely Umesh Singh, a Coordinate Bench of this Court in order dated 15.10.2015 passed in Cr. Misc. No.34295 of 2015 observed that only one injury was
Patna High Court Cr.Misc. No.58047 of 2015 (2) dt.04-01-2016 2/2 found on the head of the deceased and even after completion of investigation, the investigating agency could not succeed to collect the evidence to show who was author of the aforesaid injury. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, namely, Ashok Singh be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Session Judge-VI, Danapur, Patna in connection with Session Trial No.744 of 2015 arising out of Maner P.S. Case No.533 of 2014.
