JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 19-08-2017 Heard learned counsel for the petitioner and State The petitioner is accused in Farbesganj P.S. Case No. 263 of 2017 for the offences under Sections 399/402 of the Indian Penal Code and Sections 25(1-b)A/26/35 of the Arms Act. The petitioner and other co-accused were apprehended by the police and one country made pistol loaded with cartridge was recovered from the vehicle where the petitioner and others were present.

It appears that other co-accused, having similar allegation, have been granted bail by this Court. Reference in this connection may be made to the order dated 20.7.2017 passed in Cr. Misc. No. 33153 of 2017 by which co-accused Sintu Kumar and Rajan Singh have been granted bail, whereas co-accused

Patna High Court Cr.Misc. No.38356 of 2017 (2) dt.19-08-2017 2/2 Devi Lal Yadav @ Devi Lal has been granted bail by this Court in Cr. Misc. No. 38072 of 2017 vide order dated 10.08.2017. On the ground of parity, let the petitioner above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Araria or the successor Court in connection with Farbesganj P.S. Case No. 263 of 2017, subject to the condition that the petitioner will extend full cooperation in the conclusion of the trial and will not, in any manner, tamper with the evidence or influence the witnesses.
