JUSTICE SATYAVRAT VERMA ORAL ORDER 02-08-2022 The learned counsel for the petitioners seeks permission to withdraw the anticipatory bail application against petitioner No. 2 Anil Yadav as he has been arrested during the pendency of the application.

Permission is accorded.

Heard learned counsel for the rest petitioner and learned APP for the State.

The petitioner no.1 apprehends his arrest in connection with Sherghati (Dobhi) P.S. Case No. 292 of 2021 registered for the offences punishable under Sections 341, 342, 323, 307, 379, 504/34 of the I.P.C.

It is next submitted that petitioner No. 1 is a person

No.71949 of 2021(2) dt.02-08-2022 2/3 with clean antecedent and the informant alleges that Satendra Yadav, Kishore Yadav (petitioner no.1) and Anil Yadav assaulted on head of the informant Mantu Yadav with iron rami and Suraj assaulted Pappu Kumar with khanti and the reason for the occurrence is that the petitioner protested the act of the informant of tying the animals in front of his house. The learned counsel for the petitioner submits that the allegation with respect to the petitioner is general and omnibus. Though, it is alleged that all the three accused assaulted Mantu Yadav by iron rami. It is next submitted that the injuries suffered by Mantu Yadav is on head, hand and elbow and the injuries are in simple in nature. It is next submitted that the occurrence took place on a very trivial issue and petitioner is not a criminal. Learned A.P.P. opposes the bail application.

Considering the submissions made by the learned counsel for the petitioner, the petitioner, above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending in connection with Sherghati (Dobhi) P. S. Case No.292
