JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 29-01-2016 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners seek pre-arrest bail in connection with Sahebpur Kamal P.S. Case No.247 of 2015 registered under Sections 147, 148, 149, 307 and 353 of the Indian Penal Code as well as Section 27 of the Arms Act.

It has been contended that save and except hypothetical presumption and wild suspicion, there is no material to connect the petitioners with the alleged offence. It has been further contended that no police personnel was hurt in any manner in the alleged incident and co-accused Sashi Chand Yadav @ Sashi Chandra Yadav and Kamal Yadav having more or less identical allegation

Patna High Court Cr.Misc. No.57688 of 2015 (2) dt.29-01-2016 2/2 have already been granted anticipatory bail by a co-ordinate Bench of this Court vide order dated 06.11.2015 passed in Cr. Misc. No.50693 of 2015.

Having regard to the facts and circumstances of the case, the petitioners, namely, Chandan Yadav and Subodh Yadav, who are reported to be men of clean antecedent, in the event of arrest/surrender in the court below within six weeks from today, are directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Sahebpur Kamal P.S. Case No.247 of 2015 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Ashwani Kumar Singh, J) Md.S./- U T
