The petitioner is apprehending his arrest in connection with Nawa Nagar P.S. Case No. 137 of 2016, registered for offences punishable under Sections 409 and 120(B)/34 of the Indian Penal Code.

It has been submitted on behalf of the petitioner that the petitioner's name has surfaced in this case only on account of confessional statement of co-accused and on the very face value of the First Information Report, no case under Section 409 and other Sections of the Indian Penal Code is made out against the petitioner.

Having heard the parties, from perusal of the F.I.R. as well as impugned order, it appears that there are materials against

Patna High Court Cr.Misc. No.55136 of 2016 (2) dt.16-01-2017 2/2 the petitioner so as to show his involvement in the present case. As such I am not inclined to grant the petitioner, the privilege of anticipatory bail.

Let the petitioner surrenders before the Court below and pray for regular bail, which will be considered by the learned Court below after taking into account the materials available on record and case diary, without being prejudiced by this order. (Vinod Kumar Sinha, J) sunil/- U
