The petitioner seeks bail in connection with Mehshi P.S. Case No.155 of 2015 registered under Sections 385, 386 and 387 of the Indian Penal Code.
Learned counsel appearing on behalf of the petitioner submits that the petitioner is not named in the First Information Report. In course of investigation, the name of the petitioner has come in the confessional statement of the co-accused Manoj Kumar Singh. Except that, there is nothing against the petitioner to show his involvement in the commission of the alleged offence. In the present case, the petitioner is in custody since 14.09.2016.

No.54786 of 2016 (3) dt.28-01-2017 2/2 Further submission is that while the petitioner is accused in six other cases but out of six cases, in four cases, the petitioner is on bail, and in two other cases, the petitioner has not been remanded, as detailed in paragraph-3 to this application. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-VI, Motihari, East Champaran, in connection with Mehshi P.S. Case No.155 of 2015. Out of the two sureties, one must be close relative of the petitioner, who will file an affidavit giving genealogy as to how he/she is related with the petitioner. The bailors will undertake to furnish information to the court about any change in the address of the petitioner.
