JUSTICE MADHURESH PRASAD ORAL ORDER 19-08-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner seeks bail in a case registered for offence under sections 147, 148, 149, 341, 323 307, 353, 504 and 120B of the IPC. As per the allegation in the FIR, on receiving information regarding a bus on fire, the informant reached the Harnaut market, where he was confronted with a violent mob. He lodged a FIR against seven named persons and 100 unknown persons.

The petitioner submits that he has falsely been implicated in the instant case as he was just bystander and in fact local people were protesting against the police party who came late to the place of occurrence in rescue of burning bus, in which seven passengers were burnt to death before police arrived to the place

Patna High Court Cr.Misc. No.39319 of 2017 (2) dt.19-08-2017 2/2 of occurrence. Petitioner has no antecedent prior to the instant case and he is in custody since 7.7.2017.

Considering the aforesaid submissions, prayer for bail of the petitioner is allowed. Let the petitioner, mentioned above, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nalanda at Biharsharif in Harnaut Police station Case No. 168 of 2017.
