JUSTICE ARVIND SRIVASTAVA ORAL ORDER 20-04-2023 Heard learned counsel for the petitioner, learned counsel for the informant and learned A.P.P. for the State. The petitioner apprehends his arrest in connection with Bhagalpur Mahila P.S. Case No.68 of 2021 registered under Sections 498(A) and 34 of the Indian Penal Code and Sections 3⁄4 of the Dowry Prohibition Act.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. It is submitted that the petitioner preferred Divorce Case No.2781 of 2021 on 17.09.2021 (Annexure 3 to the supplementary affidavit) and when the notice of this fact known by the informant, she filed the present case. The petitioner has got no criminal antecedent.
