The petitioner apprehends his arrest in Manuwapul P.S. Case No. 163 of 2015 instituted for the offences under Sections 147, 148, 149, 323, 324, 307, 302 and 504 of the Indian Penal Code.
It has been submitted that petitioner is alleged to be merely member of the mob. There is specific allegation against coaccused Bayabi Sah of assaulting on the head of son of the informant with iron rod.
The case diary has been received. The counsel for the State has submitted that cause of death is head injury, as
Patna High Court Cr.Misc. No.55206 of 2016 (3) dt.13-02-2017 2/2 mentioned in post mortem report.
In the circumstances, prayer of the petitioner for anticipatory bail is allowed.
In the event of surrender/arrest of the petitioner, named above, within six weeks from today in connection with Bettiah Muffasil (Manuwapul) P.S. Case No. 163 of 2015, he shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, West Champaran at Bettiah, subject to the conditions as laid down under Section 438(2) Cr.P.C.
