JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-08-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 395, 412 of the Indian Penal Code.

Petitioner was granted bail in this case vide order dated 14.03.2012 passed in Cr. Misc. No. 9947 of 2012 but he failed to appear before the court below as a result whereof, his bail bond was cancelled on 03.12.2012. However, petitioner was remanded in jail in connection with another case and remained in jail custody for a long period. Subsequently, he could be remanded in the present case on 30.05.2017 and since then he is in jail custody.

No.34747 of 2017 (2) dt.09-08-2017 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-IV, Gaya in connection with Sessions Trial No. 104 of 2013 arising out of Bodh Gaya P.S. Case No. 187 of 2011.
