JUSTICE SUDHIR SINGH ORAL ORDER 16-01-2017 Heard learned counsels for the petitioner, informant and learned counsel for the State.
The petitioner is apprehending his arrest in connection with Runni Saidpur P.S. Case No. 62 of 2015 for the offences instituted under Sections 498(A), 323, 379, 364 of the IPC and 3⁄4 of the D.P. Act. Later on, Sections 372 and 376 of the IPC were also added.
The prosecution story, in brief, is that the sister of the complainant/informant was married with co-accused Md. Sunna on 30.04.2014. After the marriage, her husband and other accused persons started demanding Rs. 3,00,000/- from the informant for doing business. Due to non-fulfilment of dowry demand, she was
Patna High Court Cr.Misc. No.1185 of 2017 (2) dt.16-01-2017 2/3 assaulted. On 06.11.2014, the informant got information that his sister is not in her Sasural. He went there and enquired about his sister but the accused did not give any satisfactory reply. He also got information that his sister was sold to one Ajit Ram. He has suspicion that the accused persons have sold his sister to Ajit Ram and disappeared her.
It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering with the witnesses alleged against the petitioner. He has falsely been implicated in the present case. There is no specific allegation against him. The other co-accused have been granted anticipatory bail by another co-ordinate Benches of this Court vide Annexures-3 and 4 to the present application. Learned counsels for the informant and the State have vehemently opposed the prayer for bail of the petitioner and have stated that the petitioner is named in the F.I.R. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Runni Saidpur P.S. Case No. 62/2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the
