Petitioners apprehends their arrest in a case registered for the offences punishable under Sections 272, 273/34 of the IPC and section 30(a) of Bihar Prohibition and Excise Act. As per prosecution case, 108 liters of country made liquor has been recovered from motorcycle.

Petitioners have been made accused in this case simply because they are sons of the co-accused Vindeshwar Prasad Sahu who is the owner of the vehicle in question. No incriminating material has been recovered from the conscious

Patna High Court CR. MISC. No.66287 of 2022(2) dt.16-12-2022 2/2 possession of the petitioners. Petitioners have got no criminal antecedent.

Considering the aforesaid facts and circumstances, let the above named petitioners in the event of their arrest/surrender before the Court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Court of Special Judge, Excise Act, Jhanjharpur, Madhubani, in connection with Laukahi P.S. Case No. 214 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
