The petitioner seeks bail in a case registered for offences under Sections 30 (A) of the Bihar Prohibition and Excise Act.
It is contended that as per allegation, 18 litres of Nepali Saufi wine were recovered from the possession of the petitioner. Petitioner claims that he is having clean antecedent and is in custody since 08.07.2017.
Considering the facts and the circumstances of the case, the petitioner, abovenamed is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten
Patna High Court Cr.Misc. No.36330 of 2017(2) dt.10-08-2017 2/2 Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II-cum-Special Judge, Excise Act, Sitamarhi in connection with Case No. C2/406 of 2017 with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
