This application for grant of anticipatory bail arises out of Gopalganj (S.C./S.T.) P.S. Case No. 02 of 2015, disclosing offences under Sections 341, 323, 379, 504/34 of the Indian Penal Code and 3 (1)(x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities), Act, 1989.
It is submitted on behalf of the petitioner that identical allegations have been made against all the accused persons, four of whom have been given the privilege of anticipatory bail by an order dated 08.05.2015 passed in Criminal Miscellaneous No. 14076 of 2015.
Considering the aforesaid submission, this application is
Patna High Court Cr.Misc. No.58533 of 2015 (2) dt.21-01-2016 2/2 allowed.
Let the petitioner, above-named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Gopalganj in connection with Gopalganj (S.C./S.T.) P.S. Case No. 02 of 2015, subject to the condition as laid down under Section 438 (2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
