The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 302 of the Indian Penal Code.

As per FIR, the allegation against the petitioner is that he committed murder of the informant's son by means of knife blow. It is further alleged that the petitioner also committed murder of his own sister because there was love affair between her sister and the informant's son. Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.69099 of 2023(4) dt.31-01-2024 2/3 petitioner is innocent and has committed no offence. He has falsely been implicated in this case due to previous enmity. The informant is not an eye witness of the alleged occurrence. It is further submitted that the petitioner has got no criminal antecedent. Moreover, he is languishing in judicial custody since 06.11.2022.

Learned APP appearing for the state has vehemently opposed the prayer of regular bail and submitted that there is specific allegation against the petitioner of commission of murder of his own sister by strangulation and the informant's son by knife blow. As per postmortem report doctor opined cause of death of deceased Rahul Kumar due to haemorrhage and shock injury caused by sharp injury and death of Nibha Kumari due to haemorrhage and shock caused by strangulation, so Postmortem Report is in consonance with the prosecution version.

Having heard the learned counsel for the parties and considering the gravity and nature of this case, this court is not inclined to enlarge the petitioner on bail and, as such, his prayer for bail stands rejected.

The trial Court is directed to expedite the trial and conclude the same within stipulated period of time i.e. seven
