JUSTICE RAKESH KUMAR ORAL ORDER 19-08-2017 Heard Smt. Babita Kumari, learned counsel for the petitioner and Mr. Md. Sufiyan, learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 04.07.2017 in Muffasil( Lakho) P.S. Case No.298/17 registered for the offence under Section 414 of the Indian Penal Code and under Section-30(a) of the Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail.

By way of referring to the statement made in paragraph-3 of the petition, learned counsel for the petitioner submits that the petitioner is having clean antecedent and on false accusation as if the petitioner was fleeing away after the vehicle was stopped, from which huge quantity of Indian Make Foreign Liquor was recovered, the petitioner has been made accused.

No.39486 of 2017 (2) dt.19-08-2017 2/2 Considering the nature of accusation, clean antecedent as well as period of custody, let the petitioner, namely, Sandhir Kumar be released on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge-7th ,Begusarai-cum- Special Judge, Bihar Prohibition & Excise Act,2016 in connection with Muffasil ( Lokho) P.S. Case no.298/17.
