This application is for grant of regular bail in connection with Bihta P.S.Case No.883 of 2016 Special Case No.92 of 2016, registered for the offences punishable under Sections 8/20(1)(c) and 29 of N.D.P.S. Act and Section 414 of the Indian Penal Code.

Earlier the prayer for bail of the petitioner was rejected by this Court, vide order dated 03.04.2017 passed in Cr. Misc. No.10530 of 2017.

Submission of the learned counsel for the petitioner is that another co-accused person has been released on bail and the petitioner is in custody for about nine months. Heard learned A.P.P. also.

Patna High Court Cr.Misc. No.40412 of 2017 (2) dt.30-08-2017 2/2 Having heard both sides and in view of the fact that earlier the prayer for bail of the petitioner had been rejected by this Court, I am not inclined to grant bail to the petitioner. However, considering the fact that the petitioner is in custody for about nine months, the learned trial court is directed to expedite the trial of the petitioner and try to conclude it within a period of nine months.

With the aforesaid observation, this application is dismissed.
