The petitioner apprehends his arrest in connection with Sandesh P.S. Case No. 29 of 2019, registered under Sections 394 and 307 of the Indian Penal Code and Section 27 of the Arms Act, pending in the court of the learned J.M. Bhojpur at Ara.
The accusation is that in the evening of 08.02.2019, informant Ashok Prasad along with son Suraj Kumar were locking his shop of ornaments situated in village -Kori, at that time, 3-4 persons come near the shop out of which one person came near the son of informant and fired through pistol at his son Suraj Kumar, but that was hit at the shuter of the shop. Thereafter, the said person came near the
Patna High Court CR. MISC. No.57105 of 2019(2) dt.09-09-2019 2/2 informant and made attempt to take bag. When informant refused to hand over the bag then he fired twice which hit to the thigh of the informant and all the four persons snatched his bag and fled away.
Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. and he falsely been implicated in this case on the disclosure made by spy. The order dated 01.08.2019 passed in ABP No. 1375 of 2019, whereby the prayer of anticipatory bail has been refused in which the name of petitioner came in the confessional statement of Nagesh Yadav showing the involvement of petitioner as detailed in para4 of the said A.B.P. Having considered the facts and circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, his prayer for grant of anticipatory bail stands rejected.
