This application is for grant of regular bail in connection with Forebesganj P.S.Case no.09 of 2017 arising out of Cr. R. No.41 of 2017 for the offences punishable under Sections 364 and 392 of the Indian Penal Code.
The petitioner is not named in the F.I.R. and it appears that his name transpired on the basis of statement of the co-accused and a Tractor was also recovered in front of the house of the petitioner.
Submission of the learned counsel for the petitioner is that nothing has been recovered from the house of the petitioner rather it has been recovered from the road outside of the house of the petitioner and further submission is that though he has been
Patna High Court Cr.Misc. No.29148 of 2017 (3) dt.24-07-2017 2/2 made accused in other case also but only after arrest in this case he has been made accused in other cases and now he is in custody for about four months.
Heard learned A.P.P. also, who has opposed the prayer for bail on the ground that he is accused in five other cases , out of which two are of similar nature.
Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner, however, the learned trial court is directed to expedite the trial and try to conclude it within a period of nine months.
With the aforesaid observation, this application is dismissed.
