JUSTICE MADHURESH PRASAD ORAL ORDER 06-12-2019 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner seeks bail in a case registered under section 394 of the IPC.

It is submitted by counsel for the petitioner that other than confessional statement of co-accused, there is nothing to link with the petitioner in the instant case. Petitioner has been made accused on account of criminal history and there is no material to connect him with the present occurrence still he is in custody since 22.04.2019.

Learned A.P.P. opposes the prayer for bail.

Considering the aforesaid submissions, prayer for bail is allowed.

Let the petitioner be released on bail on furnishing

Patna High Court CR. MISC. No.57465 of 2019(4) dt.06-12-2019 2/2 bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Jhanjharapur in Laukahi P.S. Case no. 206/2017 subject to the following conditions.

(1) One of the bailors will be his own blood relative, preferably, mother, son, brother, sister and /or his wife. (2) The petitioner shall not indulge himself in any similar offence till conclusion of the trial. (3) The petitioner shall remain physically present in court on each and every date during trial and in the event of court concerned.

(4) The petitioner shall co-operate with the investigation, if not already concluded, and make himself available as and when so required and in case of failure, the State shall be at liberty to move for cancellation of bail. (Madhuresh Prasad, J) s.hassan/- U T
