The grievance of the petitioner in the present writ petition is notwithstanding availability of vacancy in the EBC category, the respondent-BPSC is not considering the case of the petitioner, who had applied for BC category now his caste is in EBC category.

The Court does not find it a fit case to exercise

Patna High Court CWJC No.19138 of 2019(2) dt.17-09-2019 2/2 discretion in favour of the petitioner. However, the petitioner may approach the BPSC which may consider his case like other candidates against the vacancy of EBC category, if law otherwise permits.

With the aforesaid, the writ petition stands disposed of.
