Petitioner is languishing in judicial custody since 21.04.2017 in connection with Special Case No. 13/2017, arising out of Forbesganj P.S. Case No. 269/2017 for offences punishable under Sections 8/20(b)(II)(B) of the N.D.P.S. Act. The prosecution case, as lodged by the informant, who is a police personnel, is that in presence of the petitioner, the house of the father of the petitioner Md. Israil was searched and 4 Kg ganja was recovered from the house. Accordingly, a seizurelist was prepared. It has been submitted by the learned counsel for the

No.38651 of 2017 (2) dt.22-08-2017 2/2 petitioner that he is innocent, bears no criminal history and, in fact, he had accompanied the police during search and that he had no concern with the alleged ganja as the house belongs to petitioner' father and just because he is the son, he has been falsely implicated.
However, learned APP for the State opposes the prayer for bail.
Considering the facts and circumstances and the materials on record, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 1st Addl. Sessions Judge cum Special Judge, Araria, in connection with Special Case No. 13/2017, arising out of Forbesganj P.S. Case No. 269/2017.
