JUSTICE MOHIT KUMAR SHAH ORAL JUDGMENT Date : 21-12-2018 The short prayer made by the learned counsel for the petitioner in the present writ petition is that the Certificate Officer, Munger be directed to dispose of the pending Mining Certificate Case No. 16 of 2004-08/ 164 of 2008-09 expeditiously and in the meantime, some protection may be granted to the petitioner. Accordingly, the present writ petition is disposed of with a direction to the Certificate Officer, Munger to consider the objection filed by the petitioner under Section 9 of the Bihar & Orissa Public Demands Recovery Act, 1914 and pass a final order under Section 10 of the Act, 1914 with regard to the aforesaid Mining Certificate Case No. 16 of 2004-08/ 164 of 2008-09

Patna High Court CWJC No.23121 of 2018 dt.21-12-2018 2/2 pending in the court of Certificate Officer, Munger. It is further directed that till passing of the final order, no coercive steps shall be taken against the petitioner herein.
