Bodh Gaya P.S. Case No.199 of 2013 was registered against the petitioner alleging offence under Sections 467, 468, 471, 419, 420 and 120B of the Indian Penal Code, pending in the court of the Chief Judicial Magistrate, Gaya.

No.1811/13/415/13 filed by the petitioner in the court of 3rd Additional Sessions Judge, Gaya was dismissed on 22.10.2013. Hence, he filed this application.
On 14.11.2013, this Court granted interim order by issuing certain directions, such as, that the petitioner shall return the amount deposited by the investors on maturity. Six months' time was fixed thereof.
Learned counsel for the petitioner submits that no
Patna High Court Cr.Misc. No.46231 of 2013 (3) dt.10-04-2015 2/2 objection was taken from him.
Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner has already been released, may be on provisional basis, to clear the amount due to the subscribers. In case the amount has not been paid to the depositors, his bail deserves to be cancelled.
The application is, thus, disposed of. The provisional bail granted to the petitioner, through order dated 14.11.2013, shall be treated on regular basis, subject to the condition that in case the petitioner has not paid any amount on maturity of deposits made by the depositors, his bail shall stand cancelled. The Station House Officer shall verify the matter and take necessary steps accordingly.
