The application seeks restoration of CWJC No. 7633 of 2012 to its original file and number which stood dismissed for non-compliance of the order dated 20.04.2012, whereby the petitioner was peremptorily directed to file supplementary affidavit within 02 weeks.

It is stated that the time granted under order dated 20.04.2012 expired on 05.05.2012 whereas the supplementary affidavit was filed on 07.05.2012. The reason for delay has been explained.

Considering the facts and circumstances of the case, the

Patna High Court MJC No.4231 of 2012 (3) dt.06-04-2016 2/2 application is allowed. Time granted under order dated 20.04.2012 is extended to 07.05.2012 subject to deposit of a cost in the sum of Rs. 250/- with the Patna High Court, legal Services Committee and filing receipt thereof within 10 days.
