Petitioner seeks bail in connection with Mithanpura P.S. Case No. 137 of 2017 for offences punishable under Sections 25 (1-b) a, 26, 35 of the Arms Act.
The prosecution case, as lodged by the police personnel, is that while on patrolling duty, one Vikash Kumar was arrested who confessed his guilt and disclosed that he is an accused in Mithanpura P.S. Case No. 95 of 2017 and is member of notorious criminals, Anjani Thakur gang. Thereafter on his statement, the police raided the campus of Health Department and arrested three persons including the petitioner. From the possession of the petitioner one country made pistol and four live cartridges were recovered.

No.36844 of 2017 (3) dt.12-10-2017 2/3 It has been submitted by the learned counsel for the petitioner that he is innocent and it is only on the basis of confessional statement of co-accused, he has been made accused and that he has no concern with the criminal gang. He submits that apart from the present case, he has been implicated in Mithanpura P.S. Case No. 95 of 2017 in which he has been granted privilege of bail. He submits that the petitioner was working in Jeans factory at Delhi and had come to attend the marriage ceremony at his sasural and has falsely been implicated. He submits that charge-sheet has already been submitted and there is no allegation of tampering of the prosecution witnesses by the petitioner and that he is languishing in judicial custody since 12.05.2017.
However, learned APP for the State opposes the prayer for bail.
Considering the facts and circumstances and the materials on record, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., East, Muzaffarpur in connection with Mithanpura P.S. Case No. 137 of 2017, subject to the conditions that: (1) One of the bailors would be a close

(2) Petitioner will appear before the learned court below during trial as and when required and failure to appear on two consecutive dates without assigning any reason will entail cancellation of his bail bonds.
